The Court granted anticipatory bail to the petitioners subject to bond, sureties and verification of antecedents.

Summary

The petitioners, Nirsi Devi and Suraj Sahni, applied for anticipatory bail in a case registered under Sections 30(a) and 41(1) of the Bihar Excise Act for allegedly recovering five litres of liquor from a public place near the Collectorate in Patna. They argued that they have clean antecedents, were not apprehended at the spot, no liquor was found in their possession, and the FIR does not disclose the informant, casting doubt on the prosecution’s case. The State opposed the bail. The Court, after considering the submissions, ordered that the petitioners be released on bail upon furnishing a bond of Rs. 500 each with two sureties, subject to Section 482(2) of the BNSS and verification of their criminal antecedents by the trial court. The order further provides that if any prior case is discovered, the provisional bail will be revoked; otherwise, the bail will be confirmed. The decision rests on the lack of direct evidence, the public nature of the location, and the petitioners’ clean record.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under the Bihar Excise Act.
  • Whether the absence of apprehension and lack of possession of liquor justify bail.
  • Whether the lack of disclosure of the informant in the FIR affects the prosecution’s case.
