Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on condition of a Rs. 500 bond and two sureties.

Summary

Rahul Sahani was arrested in connection with the alleged recovery of 240 litres of liquor from a public place near a river, under Section 30(a) of the Bihar Excise Act. The petitioner, who has six prior excise cases, argued that he was not apprehended at the spot, had no conscious possession of the liquor, and was implicated by a hostile chowkidar, raising doubts about the prosecution's case. He had been in custody since 5 January 2026 and sought bail, assuring the court of his cooperation and that he would not abscond. The State opposed bail, citing the seriousness of the offence and the petitioner’s prior record. The court, after considering the submissions, concluded that the circumstances did not warrant continued detention and ordered his release on bail upon furnishing a bond of Rs. 500 with two sureties.
