The Court ordered provisional anticipatory bail subject to verification of the petitioner’s antecedents, with confirmation if no prior case is found.

Summary

Balmiki Sahani sought anticipatory bail after learning that he might be arrested in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, alleging recovery of 35 litres of liquor from a mango orchard owned by Harilal Prasad. The petitioner asserted that he has a clean antecedent, that the liquor was not found in his possession, and that he has no relationship with the orchard owner, having been implicated only through a hostile watchman. The State opposed the bail application. The High Court, considering these submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.500 with two sureties and that the trial court verify his antecedents. If any prior case is discovered, the bail will not be confirmed; if his antecedents are clean, the bail will be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
  • Whether the petitioner’s alleged lack of possession and clean antecedent justify anticipatory bail.
