BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioners subject to a bond and conditions under Section 482(2) of the B.N.S. 2023.

Summary

The petitioners, Usha Devi and Rishi Baitha, sought anticipatory bail fearing arrest in a case (Chapra Muffasil P.S. Case No. 284 of 2025) where they were accused of assaulting an informant and her son with a sharp weapon, leading to minor injuries. The FIR listed offences under Sections 126(2), 115(2), 118(1), 109, 352, 303(2) and 3(5) of the B.N.S. 2023. The petitioners argued that the dispute stemmed from a land conflict between neighbours and that the injuries were simple, also noting a counter‑case filed by them. The court, considering the neighbourly land dispute, the modest nature of the injuries, and the existence of a counter‑case, decided to grant anticipatory bail. The bail was conditioned on a bond of Rs. 10,000 with two sureties and compliance with Section 482(2) of the B.N.S. 2023, to be executed within four weeks of the order.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the B.N.S. 2023 in view of the alleged offences.
  • Whether the context of a land dispute and the simple nature of injuries justify the grant of anticipatory bail.
