Patna High Court

Yogendra Bhagat @ YogendraversusThe State of Bihar

DISPOSED

Holding

The Court conditionally granted provisional anticipatory bail, subject to bond, sureties and verification of criminal antecedents.

Summary

The petitioners, Yogendra Bhagat and Sadanand Rao, sought anticipatory bail fearing arrest in a case under the Bihar Excise Act for allegedly recovering 466.02 litres of liquor from a pickup van. They contended that they were not in conscious possession, were not owners of the vehicle, and were implicated solely on confessional statements of co‑accused made in police custody, which they argued lack evidentiary value. They further submitted that the 2018 amendment to the Excise Act abolished the concepts of deemed possession and presumed offender. The State opposed the bail. The Court granted provisional anticipatory bail subject to a Rs.5,000 bond, two sureties, and verification of the petitioners' criminal antecedents, with the order to be confirmed or set aside after such verification.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under the Bihar Excise Act.
  • Whether confessional statements of co‑accused made in police custody are admissible for bail considerations.
  • Whether the 2018 amendment to the Bihar Excise Act eliminates the doctrine of deemed possession and presumed offender.

                   learned A.P.P. for the State.

                             2. The petitioners apprehend their arrest in a case

32(1)(2), 41(1)(2) of the Bihar Excise Act.

                             3. Learned counsel for the petitioners submits that

petitioner no. 1 has antecedent of one case under the Excise Act

allegation is of recovery of 466.02 litres of liquor from a pickup

                   van.

recovered from their conscious possession and is not the owner

of the seized vehicle and they came to be implicated based on

confessional statement of Sagir and Rizwan in police custody

which does not have any evidentiary value. It is next submitted

that after amendment in the Excise Act in the year 2018, the

concept of deemed possession and presumed offender has been

          done away with.

                   5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioners.

                   6. Considering the submissions made by the learned

counsel for the petitioners, the petitioners above-named, in the

event of their arrest or surrender within a period of six weeks

from today, be released on provisional anticipatory bail on

furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand)

          482(2) of the BNSS.

                   7. It is made clear that thereafter the learned Trial Court

shall verify the criminal antecedent of the petitioners and in the

event if it is found that petitioner no. 1 has antecedent of more

than one case and petitioner no. 2 has antecedent of even one

case then it would be presumed that petitioners, for the purposes of

seeking anticipatory bail, had concealed their antecedent before

this Court, as such, the provisional anticipatory bail order shall not
