Patna High Court

Bipul Singh @ Muthan Singh @ Bipul KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court ordered that regular bail be granted to both petitioners on the condition of a Rs.10,000 bail bond with two sureties each.

Summary

The petitioners, Bipul Singh and Patar Singh, were arrested in connection with FIR No.187 of 2025 alleging assault with weapons, including a farsa, resulting in injury to an informant. They sought regular bail under sections 126(2), 115(2), 118(1) and 109 of the Bhartiya Nyaya Sanhita, 2023, claiming they were falsely implicated and that the allegations against them were vague. The State opposed bail, citing specific allegations that petitioner No.1 participated in the assault causing serious injury. After hearing both sides, the court examined the FIR details and the informant’s testimony about the injury. The court concluded that bail could be granted, directing the petitioners to furnish a bail bond of Rs.10,000 with two sureties each, subject to the satisfaction of the Judicial Magistrate.

Issues considered

  • Whether regular bail should be granted to the petitioners despite the serious assault allegations under the Bhartiya Nyaya Sanhita.
  • Whether the allegations against the petitioners are specific enough to justify denial of bail.

2 08-04-2026 1. Heard learned counsel for the parties.

                                2. The petitioners have preferred this application for

grant of regular bail in connection with Gaura P.S. Case no.187

                   of 2025 registered under sections 126(2), 115(2), 118(1) and 109

of the Bhartiya Nyaya Sanhita, 2023.

                                3. As per the prosecution case, nine named accused

persons are said to have come armed with lathi, danda, farsa

etc. It is stated by the informant that they started to abuse and

assault the informant and others. Rajesh Singh, Golu Singh and

the petitioner no.1 assaulted the informant with a farsa. As a

result of assault by Rajesh Singh with farsa, the informant

sustained injury on his head. It is further stated that in the

assault by all the accused persons, the informant and others

sustained injuries. On the intervention of the villagers, they

          were saved.

                       4. Learned counsel for the petitioners submits that the

petitioners have been falsely implicated in the case. No such

occurrence as alleged has taken place. Even as per the FIR, the

informant sustained injury as a result of assault by Rajesh

Singh. The allegations against the petitioners are general and

omnibus in nature. They are in custody since 4.2.2026 and

undertake to cooperate in the investigation/trial.

                       5. The application for bail is opposed by learned A.P.P

for the State and learned counsel for the informant. Learned

counsel for the informant submits that besides both the

petitioners being named in the FIR, there is direct and specific

allegation against the petitioner no.1 of having assaulted the

informant with a farsa along with two others causing serious

          injuries.

                       6. Having heard learned counsel for the parties and

taking into consideration the allegations in the FIR, the
