The court granted regular bail to the petitioner, directing release upon furnishing a bail bond with sureties.

Summary

The petitioner, Krishna Sharma, applied for regular bail in a criminal miscellaneous case concerning the alleged possession of 236.73 litres of illicit foreign liquor, alleged under section 30(a) of the Excise Act. The prosecution argued that the liquor was recovered from an open place near the petitioner’s house, implying his involvement. The petitioner contended that he had no conscious possession of the liquor, that the seizure was conducted by police who failed to comply with the mandatory provisions of Section 105 of the Bihar Narcotic Substances Act, and that he was falsely implicated. The State opposed the bail, citing the seriousness of the offence and the petitioner’s three prior criminal antecedents. After considering the facts, the court found merit in the petitioner’s arguments and ordered his release on regular bail upon furnishing a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail should be granted to the petitioner under section 30(a) of the Excise Act.
  • Whether the seizure of the liquor complied with the mandatory provisions of Section 105 of the Bihar Narcotic Substances Act.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of bail.
