Patna High Court

Pushpa Narayan Yadav @ Puhuplal YadavversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

Anticipatory bail was not granted to the petitioner.

Summary

The petitioner, Pushpa Narayan Yadav, applied for anticipatory bail fearing arrest in a dowry‑related murder case (PS Case No. 134 of 2025). The prosecution alleged that he, as the father‑in‑law of the deceased, participated in the killing of his daughter‑in‑law to demand dowry, invoking Sections 85, 80, 238 and 3(5) of the B.N.S. Act and Sections 3 and 4 of the Dowry Prohibition Act. The petitioner contended his innocence, clean antecedents and that he was falsely implicated. The State opposed the bail, arguing the seriousness of the offences and the likelihood of his involvement. Justice Sandeep Kumar, after hearing both sides, declined to grant anticipatory bail, finding the allegations sufficient to justify denial. Consequently, the petition for anticipatory bail was dismissed.

Issues considered

  • What is the appropriateness of granting anticipatory bail to the petitioner under the alleged offences?
  • Do the allegations under the B.N.S. Act and Dowry Prohibition Act justify denial of anticipatory bail?
