Patna High Court

Pintu Singh @ Pintu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Pintu Singh, was arrested on secret information for allegedly firing at police and possessing a loaded pistol, leading to charges under Sections 109 and 132 of the Bharatiya Nyaya Sanhita and Sections 25(1‑AA), 25(1‑b), 26, 27 and 35 of the Arms Act. He has been in custody since 20 January 2025 and claims innocence, noting that no police officer sustained any firearm injury. The State opposed his regular bail application, emphasizing the seriousness of the offences. The court considered the nature of the accusations, the length of custody, and the absence of injury to the police. Finding no compelling reason to continue detention, the court granted regular bail on the condition of a Rs.10,000 bond with two sureties. The petitioner was ordered to be released upon compliance with the bail conditions.

Issues considered

  • Whether regular bail should be granted to the accused despite the seriousness of the arms and assault offences
  • Whether the prolonged pre‑trial custody and lack of injury to police justify continued detention
