Patna High Court

Chunnu Singh @ Monu Singh @ Manu SinghversusThe State of Bihar

Decided
Disposal
WITHDRAWN

Holding

The Court dismissed the modification application, refusing to extend the surrender time.

Summary

The petitioner, Chunnu Singh, had been granted anticipatory bail by the High Court with a condition to surrender to the police within a stipulated time. He failed to surrender before the deadline and subsequently filed a modification application seeking an extension of the surrender period. The learned counsel for the State opposed the application. The Court reiterated its consistent stance that it will not extend the surrender time where the petitioner has not surrendered within the period fixed in the anticipatory bail order or has not approached the Court before the expiry. Consequently, the Court dismissed the petitioner's modification application.
