Subtara Khanam @ Shubhtara Khanam @ Subahtara KhanamversusThe State of Bihar

Holding

The court held that the time for furnishing bail bonds may be extended by two weeks.

Summary

The petitioner Subtara Khanam, wife of the late Islamuddin Khan, was granted anticipatory bail on 16‑12‑2025 in Criminal Miscellaneous No.84639 of 2025. She was unable to furnish the required bail bonds within the stipulated time due to unavoidable circumstances. Consequently, she filed a modification application seeking an extension of time to submit the bail bonds. The court examined whether such an extension would defeat the purpose of anticipatory bail or prejudice the State’s interest. It held that a reasonable two‑week extension would not prejudice the State and is permissible. Accordingly, the court ordered that the time for furnishing the bail bonds be extended by two weeks from the receipt of the order, and the earlier anticipatory bail order was modified accordingly.

Issues considered

  • Whether the time for furnishing bail bonds after grant of anticipatory bail can be extended
  • Whether such extension would prejudice the State's interest
