The court granted bail to the petitioners.
Summary
Petitioners Pradeep Kumar Singh and Indu Devi applied for bail in a case concerning the alleged poisoning death of the informant's daughter, who was married to their son. They were charged under sections 126(2), 115(2), 118(1), 85, 3(5) of the B.N.S. 2023, sections 2 and 4 of the Dowry Prohibition Act, and later section 80 read with 3(5) of the B.N.S. 2023. The petitioners have been in custody since 19‑12‑2025, have no prior criminal record, and contend that the allegations against them are general and omnibus. The State and the informant opposed bail, but the court noted the lack of antecedents and the nature of the accusations. Consequently, the court granted bail, ordering each petitioner to furnish a bail bond of Rs.10,000 with two sureties of the same amount.
Issues considered
- Whether bail should be granted to the petitioners despite serious charges including dowry death and related offences
- Whether the general and omnibus nature of the allegations justifies denial of bail
- Whether the petitioners' lack of prior criminal antecedents warrants bail
