The Court inclined to grant bail to the petitioner, subject to bond and conditions.
Summary
Amirka Mukhiya was arrested in connection with an Excise case (No. 1946 of 2025) for allegedly possessing 30 litres of country‑made liquor, an offence under Section 30(a) of the Bihar Prohibition and Excise Act. The petitioner claimed innocence, stating that no liquor was found in his possession and that he was implicated only by a co‑accused. He had been in custody since 15‑Nov‑2025 and possessed seven prior criminal antecedents, and the prosecution had not complied with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023. The State opposed bail, but the Court, considering the lack of incriminating material and the period of custody, decided to grant bail subject to a bond of Rs.15,000 with two sureties and specific conditions. The bail order required the petitioner’s appearance at trial and allowed cancellation of bail for repeated defaults or future similar offences.
Issues considered
- What is the appropriateness of granting bail to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given the custody period and prior criminal antecedents?
- Whether non‑compliance with Section 103 of the Bharatiya Nagarik Suraksha Sanhita, 2023, affects the grant of bail.
