The court granted bail to the petitioner subject to a bond of Rs. 10,000, two sureties, and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioner, Sujit Yadav, was implicated in a case under Section 30(a) of the Bihar Excise Act after 42.84 litres of illicit liquor were recovered from a sack tied to a motorcycle. He contended that he was not present at the scene, had no possession of the liquor or the motorcycle, and was being falsely implicated despite three prior criminal antecedents. The State opposed his bail application. The court, after considering the facts, the nature of the allegation, and the submissions of counsel, ordered that the petitioner be released on bail upon furnishing a bond of Rs. 10,000 with two sureties of the same amount, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, including cooperation with the investigation and attendance at trial. The bail bond may be cancelled if the petitioner is absent for two consecutive trial dates. The order was pronounced by Justice Sunil Dutta Mishra.
