The Court granted provisional anticipatory bail subject to bond, sureties and verification of the petitioner’s criminal antecedent.
Summary
Mukesh Rai, the petitioner, feared arrest in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 5,257.065 litres of liquor from three vehicles. He contended that he was not arrested on the spot, had no possession of the liquor, and was not the owner of the vehicles, asserting that his implication was based solely on secret information without proper investigation. The petitioner, who has a record of seventeen prior excise cases, sought anticipatory bail. The State opposed the bail. The Court granted provisional anticipatory bail, requiring a bond of Rs.85,000 with two sureties and conditioning confirmation on verification of the petitioner’s criminal antecedent, stipulating that if more than seventeen cases are found, the bail will not be confirmed, otherwise it will be confirmed.
Issues considered
- Whether anticipatory bail should be granted to the petitioner under Section 438 of the Cr.P.C. and Section 482(2) of the BNSS in view of the alleged offence under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 and his prior criminal antecedent.
