Patna High Court

Ravi Singh @ Ravindra SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted regular bail to the petitioner, directing him to furnish a bail bond of Rs 10,000 with two sureties.

Summary

The petitioner, Ravi Singh, was arrested in a case under the Arms Act (Sections 25(1‑AA), 25(1‑B), 25(1‑Ba), 26 and 35) after an informant alleged that a shop was manufacturing country‑made pistols. The petitioner’s name appeared in the FIR only through a confessional statement made by an accused, Vikas Kumar, while in police custody, which the petitioner’s counsel argued has no evidentiary value. The petitioner asserted a clean antecedent, had been in custody since 20 March 2026, and claimed he would not abscond and would cooperate with the trial. The State opposed the bail application. The Court, after considering the lack of direct evidence linking the petitioner to the offence and his personal circumstances, ordered that he be released on regular bail upon furnishing a bond of Rs 10,000 with two sureties.

Issues considered

  • Whether regular bail can be granted when the petitioner’s name is mentioned only in a confessional statement of another accused.
  • Whether the petitioner is likely to abscond or tamper with evidence in the Arms Act case.
