The High Court quashed the order taking cognizance of the offences under Section 498A IPC and Sections 3/4 of the Dowry Prohibition Act, as the parties had amicably settled the dispute.

Summary

The petitioners filed an application invoking the High Court's inherent jurisdiction to quash an order dated 09‑01‑2023 of the Judicial Magistrate, Patna City, which had taken cognizance of offences under Section 498A IPC and Sections 3 and 4 of the Dowry Prohibition Act. The petitioners produced a supplementary affidavit showing that they had reached a mutual compromise, had filed a joint petition under Section 13B of the Hindu Marriage Act for divorce by mutual consent, and sought disposal of the pending criminal case. The opposite party did not contest the existence of the compromise. Relying on Supreme Court precedents (Narinder Singh v. State of Punjab and Naushey Ali v. State of Uttar Pradesh) that criminal matters of a civil or matrimonial nature should be quashed when the parties have settled, the Court held that proceeding with the trial would be futile and an abuse of process. Consequently, the order taking cognizance of the offences was quashed. Both applications were allowed, resulting in the dismissal of the criminal proceedings.

Issues considered

  • Whether criminal proceedings under Section 498A IPC and the Dowry Prohibition Act can be quashed on the ground of a mutual compromise between the parties.
  • Whether the High Court may exercise its inherent jurisdiction to set aside the magistrate's order taking cognizance of the offences.
  • Whether a settlement under Section 13B of the Hindu Marriage Act extinguishes the criminal liability arising from the matrimonial dispute.
