Holding
The court held that the petitioners are entitled to bail pending trial as the allegations, while serious, do not warrant continued pre‑trial detention.
Summary
The petitioners, Saheb Kumar and Raushan Kumar, were arrested in connection with a counterfeit currency case after police intercepted two suspects and recovered counterfeit Indian and Nepali notes. Interrogation of the suspects led to a raid on the house of Pramod Kumar, where a large quantity of counterfeit notes, printing materials, and chemicals were seized, and the petitioners were apprehended. The petitioners were charged under multiple sections of the Indian Penal Code/Bharatiya Nyaya Sanhita, including offences relating to forgery, counterfeiting, and criminal conspiracy. They filed a prayer for bail, arguing that the evidence did not justify continued detention. The court considered the nature of the offences, the material seized, and the risk of tampering with evidence, and ultimately granted bail on the condition of a Rs.10,000 surety, directing the petitioners to cooperate with the investigation.
Issues considered
- Whether the petitioners are entitled to bail despite being charged with offences under Sections 317(5), 318(4), 61(2), 338, 336(3), 340(2), 111, 178, 179, 180, 181 and 3(5) of the IPC/Bharatiya Nyaya Sanhita.
- Whether the seizure of a large quantity of counterfeit currency and printing materials justifies denial of bail.
- Whether the alleged involvement in a counterfeit printing gang creates a risk of evidence tampering or further offences warranting continued detention.
Legislation cited
- Bharatiya Nyaya Sanhita, 2023 — s. 111, 178, 179, 180, 181, 317(5), 318(4), 336(3), 338, 340(2), 3(5), 61(2)
- Indian Penal Code — s. 111, 178, 179, 180, 181, 317(5), 318(4), 336(3), 338, 340(2), 3(5), 61(2)
