Holding

The Court granted provisional anticipatory bail to the petitioners, subject to conditions and verification of their antecedent records.

Summary

Petitioners Mohit Yadav and Pappu Yadav applied for anticipatory bail fearing arrest in a case under Sections 30(a), 32 and 41(i) of the Bihar Prohibition and Excise Act, alleging that the seized liquor and vehicles were not in their possession and that they were implicated by a hostile watchman without proper investigation. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail subject to the petitioners surrendering within six weeks, furnishing bail bonds of Rs.20,000 each with two sureties, and depositing Rs.2,500 with the Patna High Court Advocate Association. The Court also directed verification of the petitioners' criminal antecedents, stating that if they have more cases than disclosed, the bail would not be confirmed; otherwise, the provisional order would be confirmed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 438 of the Cr.P.C. in view of the alleged offences under the Bihar Prohibition and Excise Act and their criminal antecedents.
