Holding

The court granted bail to the petitioner.

Summary

The petitioner, Pintu Nut, sought bail for an alleged offence under Section 310(2) of the Bharatiya Nyaya Sanhita arising from a robbery in which a gold bracelet and chain were stolen. The prosecution alleged that the petitioner was part of a group that surrounded the informant on a motorcycle and snatched the items at gunpoint. The petitioner’s counsel argued that he was falsely implicated, no material was recovered from him, and his name appeared only in a confessional statement of another accused who had already been granted bail. The State opposed the bail, but the court noted the absence of a thorough investigation (no TIP) and the petitioner’s prolonged custody since July 2025. Consequently, the court ordered the petitioner’s release on bail upon furnishing a bond of Rs. 10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner under Section 310(2) of the Bharatiya Nyaya Sanhita given the circumstances of the alleged robbery.
