Patna High Court

Bali Nut @ Balli NutversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner upon the condition of furnishing a Rs.5,000 bond with two sureties.

Summary

The petitioner, Bali Nut, was arrested in connection with offences under several sections of the Indian Penal Code (147, 148, 149, 341, 323, 325, 332, 333, 307, 353) and Section 30(a) of the Bihar Excise Act. He had been in custody since 11‑11‑2025 and earlier sought regular bail, which was denied on 16‑01‑2026 with liberty to re‑apply after charge‑framing. Charges were framed on 17‑03‑2026, and the petitioner renewed his bail prayer, assuring the court he would not abscond and would cooperate with the trial. The State opposed bail, citing the seriousness of the charges. The Court, after considering the submissions, ordered the petitioner’s release on bail upon furnishing a Rs.5,000 bond with two sureties of equal amount, subject to the satisfaction of the trial court.

Issues considered

  • What is the appropriateness of granting bail to a petitioner charged with multiple serious IPC offences and an excise law violation?
  • Whether the petitioner is likely to abscond or tamper with evidence if released on bail.
