Patna High Court

Deepak Kumar @ Dipak KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner subject to specified conditions.

Summary

The petitioner, Deepak Kumar, was arrested in connection with a robbery and armed assault alleged to have occurred on 12-08-2025, involving theft of an iPhone and gold chain. The FIR did not name him; his name emerged later during investigation, and no stolen items were recovered from his possession. The petitioner claimed false implication and highlighted his custody since 22-08-2025 and three prior criminal antecedents. The State opposed bail, citing the seriousness of the offences under the Bharatiya Nyaya Sanhita, 2023 and the Arms Act. The court, considering the lack of incriminating evidence, the petitioner’s non‑naming in the FIR, and the period of custody, granted bail on a bond of Rs.15,000 with two sureties and imposed conditions regarding appearance and non‑tampering with evidence.

Issues considered

  • Whether the petitioner is entitled to bail despite being implicated in offences under Sections 309(4), 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.
  • Whether the absence of the petitioner’s name in the FIR and lack of recovered stolen articles justify granting bail.
