Bench

Holding

The court held that bail must be granted to the petitioner.

Summary

Dipak Pradhan was arrested in connection with a case of looting and charged under Section 309(4) of the Bharatiya Nyaya Sanhita. He had been in custody since 2 October 2025 and had one prior antecedent, but no TIP (time‑in‑process) investigation had been conducted. The prosecution opposed his bail, arguing the seriousness of the alleged theft. The court considered the length of his detention, the lack of investigative steps, and his antecedent record. Finding that continued custody was unwarranted, the court ordered his release on bail. He was required to furnish a bail bond of Rs.10,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the petitioner under Section 309(4) of the Bharatiya Nyaya Sanhita given the circumstances of the case.
