The court granted anticipatory bail to the petitioner with specified conditions, including a payment of Rs. 10,000 to the Advocate’s Association.

Summary

Diwakar Singh petitioned the Patna High Court for anticipatory bail after being implicated in a case (Rajoun P.S. Case No. 167 of 2022) involving illegal sand mining, firing, and multiple offences under the Indian Penal Code and the Arms Act. The prosecution alleged that a group, including the petitioner, was involved in excavating sand at a prohibited site and fired 50 rounds when police arrived, seizing five unregistered tractors. The petitioner contended he did not own any tractor, was merely passing through, had no criminal antecedent, and cited that a co-accused had been granted anticipatory bail in a similar case. The court, noting the seriousness of the allegations but also the petitioner's lack of prior record and willingness to cooperate, granted anticipatory bail subject to a payment of Rs. 10,000 to the Advocate’s Association and several conditions, including sureties, regular court appearances, and non‑tampering with witnesses. The order directed that if arrested within four weeks, the petitioner be released on bail upon compliance with the stipulated terms.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the circumstances of the case
  • Whether the court can condition anticipatory bail on payment to the Advocate’s Association
  • Whether the petitioner’s lack of criminal antecedent and the grant of bail to a co‑accused justify granting bail
