Holding

The High Court granted provisional anticipatory bail subject to conditions and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Sanjay Kumar Pandey, sought anticipatory bail after an FIR was lodged under Section 30(a) of the Bihar Excise Act alleging he concealed 35.28 litres of liquor. He argued that the liquor was recovered from a location not belonging to him, that he was not apprehended on the spot, and that the complaint was instigated by a village watchman (chowkidar) with possible ulterior motives. The State opposed the bail, contending the seriousness of the offence. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs. 5,000 with two sureties, subject to verification of the petitioner’s criminal antecedent by the trial court. The order stipulated that if more than one prior case is found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Excise Act.
  • Whether the petitioner’s alleged lack of possession and the circumstances of the seizure justify bail.
  • Whether the petitioner’s criminal antecedent affects the grant of anticipatory bail.
