The petitioner is entitled to bail.

Summary

Madan Sharma was arrested in connection with a murder case (S.Tr. No. 700 of 2025) alleging that he tied and assaulted the husband of an informant, leading to the victim's death. The petitioner contended that he was falsely implicated, asserting that the deceased had an illicit relationship with a woman and had attempted rape, for which a counter‑case was filed. He highlighted that co‑accused Golu Sharma and Deepak Sharma had previously been granted bail in similar matters. The State opposed bail, but the court noted the petitioner’s lack of prior criminal record, his custody since 12‑06‑2025, and the precedent of bail in analogous cases. After considering the facts and circumstances, the court ordered that the petitioner be released on bail upon furnishing a bond of Rs 10,000 with two sureties.

Issues considered
