Patna High Court

Sonu Kumar @ Sonu Kumar ChaudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners subject to bond, sureties, and statutory conditions.

Summary

Petitioners Sonu Kumar and Ganesh Kumar sought anticipatory bail fearing arrest in a case registered under several sections of the Bharatiya Nagarik Suraksha Sanhita (BNSS) for alleged assault on an informant. The FIR contained a general and omnibus allegation against them, while the grievous injury was attributed to a co-accused, Raja Kumar, and the petitioners were said to have caused only simple injuries. The State opposed the bail on the basis of the FIR allegations. The Court examined the nature of the allegations and noted that the petitioners were not the principal perpetrators of the serious injury. Consequently, the Court ordered that the petitioners be released on anticipatory bail if arrested or they surrender within four weeks, subject to a bail bond of Rs.10,000 with two sureties each, and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners despite the general and omnibus allegations in the FIR
  • Whether the petitioners' alleged involvement in simple injuries warrants denial of bail
