The Court granted anticipatory bail to the petitioner subject to specified conditions.
Summary
The petitioner, Anil Yadav, sought anticipatory bail fearing arrest in a case involving the seizure of 147.78 litres of foreign liquor, four cartridges and two motorcycles, alleged under sections of the Bhartiya Nyay Sanhita, Arms Act and Bihar Prohibition and Excise Act. He contended that the FIR was fabricated, that his name was implicated only through third‑party disclosures, and that the recovery procedure violated Section 100 of the CrPC/Section 103 of the Bhartiya Nagarik Suraksha Sanhita. The State opposed bail, invoking Section 76(2) of the Bihar Prohibition and Excise Act and citing the petitioner’s prior criminal antecedent. The Court, relying on the Full Bench decision in Ram Vinay Yadav v. State of Bihar, held that anticipatory bail could be granted despite the seriousness of the offences, subject to strict conditions. Accordingly, the Court ordered anticipatory bail on a Rs 10,000 bond with two sureties, imposing conditions under Section 438(2) CrPC and Section 482(2) B.N.S. and mandating cooperation with the trial and verification of antecedents.
Issues considered
- Whether anticipatory bail is permissible in a case involving offences under the Bhartiya Nyay Sanhita, Arms Act and Bihar Prohibition and Excise Act.
- Whether Section 76(2) of the Bihar Prohibition and Excise Act bars the grant of anticipatory bail.
- Whether procedural non‑compliance with Section 100 CrPC/Section 103 B.N.S. affects the bail application.
- Whether the petitioner’s prior criminal antecedent precludes anticipatory bail.
