Satish KumarversusThe State of Bihar

Decided

BAIL GRANTED

Holding

The court held that anticipatory bail is appropriate in the present case, subject to specified conditions.

Summary

The petitioners, Satish Kumar and his father Surendra Sharma, sought anticipatory bail fearing arrest in a case (Masaurhi PS Case No.428 of 2025) alleging procurement of a fake ration card and illegal receipt of subsidised food grains under sections 318(4), 316(2), 338, 336(2) and 340(2) of the Bihar Non‑Statutory (B.N.S.) Act. The prosecution argued that the petitioners have criminal antecedents, while the defence highlighted that the ration card was prepared by the village mukhiya, the complaint was filed by a litigant adversary, the father is 73 years old, and the petitioners are already on bail in the matter. The court considered the documentary nature of the case, the petitioners’ willingness to cooperate, and the lack of prior conviction, and granted anticipatory bail subject to a bail bond of Rs 10,000 with two sureties, one of whom must be a close relative, and a condition of cooperation with the investigation. The order also empowered the prosecution to seek cancellation of bail if the petitioners fail to cooperate. The judgment thus balances the presumption of innocence with the need to ensure investigation proceeds.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners accused of procuring a fake ration card under the specified sections of the B.N.S. Act.
  • Whether the petitioners’ alleged criminal antecedents justify denial of anticipatory bail.
  • Whether the involvement of the village mukhiya in preparing the ration card and the documentary nature of the evidence affect the bail decision.
