Sahadat AnsariversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The bail application is dismissed; the petitioner is not entitled to bail.

Summary

The petitioner, Sahadat Ansari, applied for bail in a criminal case (PS Case No. 382 of 2024) alleging rape under Sections 64(i) and 3(5) of the Bharatiya Nyaya Sanhita. The prosecution alleges that the petitioner committed rape and that his wife participated in the crime. The petitioner’s counsel argued that only three of seven witnesses had been examined and that a medical doctor’s report indicated no signs of rape. The court, citing the seriousness of the offence, the fact that trial had already commenced, and the Supreme Court’s decision in X v. State of Rajasthan (2024 SCC Online SC 3539), declined to revisit its earlier order denying bail. Consequently, the bail application was dismissed, and the Superintendent of Police was directed to ensure attendance of the remaining witnesses, including an informant who was reportedly reluctant to prosecute. The order was communicated to the police for compliance.

Issues considered

  • Whether bail should be granted in a rape case under Sections 64(i) and 3(5) of the Bharatiya Nyaya Sanhita given the gravity of the offence and trial status
  • Whether the medical evidence and limited witness testimony affect the bail decision
  • Applicability of the Supreme Court precedent in X v. State of Rajasthan to the present bail application
