Anticipatory bail is denied as the case does not merit such relief given the gravity of the offences.

Summary

The petitioner, Sudhir Kumar Paswan, filed an anticipatory bail application fearing arrest in a case registered as Sikraul P.S. Case No. 06 of 2026. The case involves offences under multiple sections of the Bharatiya Nyaya Sanhita—including murder‑related sections such as 191(2), 191(3), 126(2), 115(2), 109, 50, 61(2), 103(1), 351(2) and 352—as well as section 27 of the Arms Act. The prosecution’s case is based on a self‑inculpatory statement of a co‑accused, Kanhaiya Chaubey, who admitted that the petitioner participated in the violent incident that resulted in one death and four injuries. The court examined the gravity of the offences and the seriousness of the allegations. Considering the nature of the alleged crimes, the court held that the case was not suitable for anticipatory bail. Consequently, the application for anticipatory bail was rejected, with the court noting that its observations are limited to this application and will not prejudice any later proceedings.
