Patna High Court

Avinash Yadav @ Avinash Kumar YadavversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to pre‑arrest bail subject to the conditions imposed by the Court.

Summary

Avinash Yadav applied for pre‑arrest bail in a case (PS No. 94 of 2026) alleging violation of Section 30(a) of the Bihar Prohibition and Excise Act for possession of 53.6 litres of illicit liquor recovered from an open canal area. The petitioner claimed he was falsely implicated and had no involvement in the liquor trade. The State opposed the bail, but the High Court noted the recovery was from a public place and the State had not effectively implemented its liquor policy. Consequently, the Court directed that the petitioner be released on pre‑arrest bail upon furnishing a Rs.10,000 bond with two sureties, subject to verification of his criminal antecedents and compliance with Section 482(2) of the BNSS. The bail application was disposed of with the order that any future involvement in similar offences would lead to his custody.

Issues considered

  • Whether the petitioner is entitled to pre‑arrest bail under Section 30(a) of the Bihar Prohibition and Excise Act
  • Whether the circumstances of the seizure (open canal) justify bail
  • Whether the State's failure to implement its liquor policy affects bail considerations
