The court granted anticipatory bail to the petitioners.
Summary
Ramanand Singh and his wife Jaimala Devi, the father‑in‑law and mother‑in‑law of informant Khusboo, sought anticipatory bail fearing arrest in a dowry‑related case (Mahnar P.S. Case No. 273 of 2024). The prosecution alleged that Khusboo was married to their son Sidharth Shankar Singh and was assaulted and evicted for not providing a car as dowry, invoking sections of the B.N.S. 2023 and the Dowry Prohibition Act. The petitioners contended that the allegations were false and stemmed from a matrimonial dispute, noting that Khusboo’s husband had already been granted anticipatory bail by a coordinate bench. The court, considering the general nature of the allegations and the prior bail to the husband, granted anticipatory bail to the petitioners subject to a bail bond and sureties, invoking Section 482(2) of the B.N.S.S. 2023. The order directs that the bail be effective for four weeks from the date of the order.
Issues considered
- Whether anticipatory bail can be granted to the petitioners despite the serious allegations under the B.N.S. 2023 and Dowry Prohibition Act.
- Whether the prior grant of anticipatory bail to the husband influences the petitioners' entitlement to bail.
- Whether the allegations constitute a false implication arising from a matrimonial dispute.
