DISPOSED

Holding

The Court conditionally granted provisional anticipatory bail, subject to verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Kanhai Chaudhary, feared arrest in a case under Section 30(a) of the Bihar Excise Act alleging concealment of 30 litres of liquor under straw in a public area. He claimed he was not caught in the act, that the alleged recovery was from a place not belonging to him, and that the investigation relied on secret information without proper inquiry. The petitioner, who has five prior excise cases, sought anticipatory bail. The State opposed the bail. The Court granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.25,000 with two sureties and that the trial court verify his criminal antecedent; if more than five prior cases are found, the bail would not be confirmed, otherwise it would be confirmed.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under the circumstances alleged.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.

                                2. The petitioner apprehends his arrest in a case

registered for the offences punishable under Section 30(a) of the

                   Bihar Excise Act.

                                3. Learned counsel for the petitioner submits that

petitioner has antecedent of five cases under the Excise Act and

                                4. Learned counsel for the petitioner submits that

petitioner was not apprehended from the spot as such nothing

and is accessible to public at large and came to be implicated

based on secret information which is the easiest way to

implicate someone. It is also submitted that once an accused is

implicated in a case relating to excise, the police starts

implicating mechanically either at the instance of Chowkidar,

local person, confessional statement or secret information

          without holding a proper investigation.

          anticipatory bail of the petitioner.

                       6. Considering the submissions made by the learned

than five cases then it would be presumed that petitioner, for the

purposes of seeking anticipatory bail, had concealed his

antecedent before this Court, as such, the provisional
