Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner subject to a bond and sureties.

Summary

The petitioner, Subhash Kumar Yadav, was arrested in connection with the alleged recovery of 324 litres of liquor from an open field behind Pawan's house, under Section 30(a) of the Bihar Excise Act. He contended that he was not caught at the spot, had no possession of the liquor, and was implicated by a hostile chowkidar, with no prior knowledge of his involvement. The petitioner also highlighted his two prior excise cases and argued that he would not abscond if released on bail. The State opposed the bail application. The court, after considering the submissions, ordered the petitioner’s release on bail upon furnishing a bond of Rs.5,000 with two sureties of the same amount, pending trial in the Fulkaha P.S. case No. 107 of 2025.
