Holding

The court modified the earlier anticipatory bail order, conditioning bail on surrender by 30‑04‑2026 and the furnishing of a Rs. 500 bond with two sureties, subject to Section 482(2) of the BNSS.

Summary

Guddu Kumar petitioned for anticipatory bail in connection with PS case No. 157 of 2025. The High Court set a condition that if the petitioner surrenders by 30 April 2026, the provisional anticipatory bail will be accepted upon furnishing a bail bond of Rs. 500 with two sureties of the same amount, subject to Section 482(2) of the BNSS. The court modified its earlier order dated 2 February 2026 to incorporate these conditions while keeping the remaining terms unchanged. The modification was made to ensure compliance with procedural safeguards under the BNSS. The order reflects the court's discretion to grant bail with specific safeguards.

Issues considered

  • What is the appropriate condition for granting anticipatory bail to the petitioner?
  • Does Section 482(2) of the BNSS apply to the grant of anticipatory bail in this case?
