The petitioner is entitled to bail in the present case.

Summary

Pinku Kumar Kamti was arrested in connection with a robbery‑theft involving a firearm, charged under Section 309(6) of the B.N.S., 2023 and Section 27 of the Arms Act. The petitioner claimed he was falsely implicated, stating that the FIR named unknown miscreants and that no material evidence was recovered from him, apart from a confessional statement. He highlighted that co‑accused in the same case had already been granted bail and that he had been in judicial custody since 2 December 2025. The State opposed bail, citing the petitioner’s prior criminal antecedent. After considering the lack of substantive evidence, the precedent of bail to co‑accused, and the length of custody, the Court ordered that bail be granted on a bond of Rs 10,000 with two sureties.

Issues considered

  • Whether bail should be granted to the petitioner under the charges of robbery‑theft and illegal possession of a firearm.
