The Court granted regular bail to the petitioner.
Summary
The petitioner, Ram Kumar Yadav, was arrested in connection with a murder case (PS Kavaiya Case No. 201 of 2024) under Sections 190, 191, 103, 118, 238, 61(2), 62 and 123 of the B.N.S., 2023. He alleged that he is innocent, has no criminal antecedent, and that the investigation produced no material evidence against him. He has been in custody since 12‑12‑2025, while a similarly situated co‑accused, Bharat Kumar, had been granted regular bail by a coordinate bench. The State opposed the bail application. Considering the lack of incriminating evidence, the petitioner’s clean record, the duration of custody, and the precedent of bail to the co‑accused, the Court allowed the bail application, directing a bond of Rs.10,000 with two sureties of the same amount.
Issues considered
- Whether the petitioner is entitled to regular bail despite the serious charges under the B.N.S., 2023.
- Whether the absence of evidentiary material and the petitioner’s clean record justify bail.
- Whether the bail granted to a similarly situated co‑accused influences the decision.
