Holding

The Court ordered that the petitioner be released on bail upon arrest or surrender, subject to bond and sureties, under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioner, Sadam Hussain, sought anticipatory bail in a case under Section 30(a) of the Bihar Prohibition and Excise Act for alleged involvement in the seizure of 31.17 litres of illicit foreign liquor. The prosecution’s case relied mainly on the statement of a local chowkidar, with no material recovered from the petitioner’s possession. The petitioner argued that he was falsely implicated and that the chowkidar’s statement was unreliable, also noting his pending criminal antecedent on bail. The State opposed the bail, contending the seriousness of the offence. The Court, after considering the limited evidence and the petitioner’s cooperation, ordered that if arrested or surrendered within six weeks, the petitioner be released on bail upon furnishing a Rs.10,000 bond with two sureties, subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail should be granted in a case under Section 30(a) of the Bihar Prohibition and Excise Act.
  • Whether the chowkidar’s disclosure statement alone constitutes sufficient material to justify denial of bail.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.

petitioner is innocent and has been falsely implicated in this
