Holding

The Court granted provisional anticipatory bail subject to bond, sureties and verification of antecedents.

Summary

Dharmendra Manjhi was implicated in the recovery of 62 litres of liquor from a motorcycle, an offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. He was not arrested at the spot and the seized vehicle was not in his conscious possession, although it was registered in his name. The petitioner, who has three prior cases under the Excise Act, sought anticipatory bail, arguing that he was unaware of his friend Sikandar's alleged misuse of the vehicle. The State opposed the bail on the ground of the seriousness of the offence and the petitioner’s criminal antecedents. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bond of Rs.15,000 and two sureties, and directed the trial court to verify the petitioner’s antecedents. It further stipulated that if more than three prior cases are found, the bail would not be confirmed, otherwise it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of anticipatory bail.
