Holding

The Court conditionally granted provisional anticipatory bail, subject to bond and verification of the petitioner’s antecedent, with the order to be confirmed only if the antecedent does not exceed five cases.

Summary

The petitioner, Surendra Yadav, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act, where 62 litres of liquor were allegedly recovered from a motorcycle. He contended that he was not arrested on the spot, had no possession of the liquor, was not the vehicle's owner, and was implicated solely on a confessional statement of a co-accused taken in police custody, which he argued lacks evidentiary value. He further submitted that the 2018 amendment to the Excise Act abolished the concepts of deemed possession and presumed offender, and that the police were mechanically implicating persons without proper investigation. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bond of Rs. 25,000 with two sureties and conditioned the order on verification of the petitioner’s criminal antecedent within six weeks, stating that if more than five prior cases are found, the bail would not be confirmed.

Issues considered

  • Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Excise Act where the accused is implicated solely on a co-accused's confessional statement.
  • Whether the 2018 amendment to the Bihar Excise Act eliminating deemed possession and presumed offender affects the bail decision.
  • Whether the petitioner’s prior criminal antecedent (five cases) influences the grant of anticipatory bail.
