Patna High Court

Pratibha KumariversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court allowed the petition for anticipatory bail, granting it subject to specified conditions.

Summary

The petitioner, Pratibha Kumari, was implicated in a FIR (Bibhutipur PS Case No.119 of 2025) for allegedly submitting a forged BTET certificate to obtain a Panchayat Teacher appointment in 2014, invoking IPC sections 420, 467, 468, 471 and 120B. She contended that the certificate was genuine, that there was no fraudulent intent, and that she had a clean antecedent, having been terminated only after the FIR was lodged eleven years later. The State and the Department of Vigilance opposed her request for anticipatory bail. The Court, after considering the submissions, granted anticipatory bail subject to conditions under Section 438(2) of the CrPC and Section 482(2) of the Bihar Negotiable Securities Act, including a bail bond of Rs 10,000 with two sureties. The order emphasized that the bail conditions could be cancelled for non‑appearance, concealment of antecedents, or commission of a similar offence, and that the observations would not affect the trial. The prayer for anticipatory bail was therefore allowed.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 of the CrPC despite the serious nature of the alleged offences
  • Whether the conditions imposed under Section 438(2) CrPC and Section 482(2) B.N.S.S. are appropriate in the present case
