Provisional anticipatory bail is granted subject to bond, sureties, and verification of antecedent, with confirmation contingent on the trial court’s findings.

Summary

The petitioner, Sanjeev Kumar, was implicated in a case under Section 30(a) of the Bihar Excise Act for the alleged recovery of 2,203.2 litres of liquor from three vehicles. He argued that he was not arrested at the scene, had no possession of the liquor, and was not the owner of the vehicles, asserting a clean criminal record. The petitioner sought anticipatory bail, contending that the information leading to his implication came from a local chowkidar and that the FIR omitted the informant's name. The State opposed the bail. The Court granted provisional anticipatory bail conditioned on a Rs. 500 bond and two sureties, directing the trial court to verify the petitioner’s antecedent before confirming the bail.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 30(a) of the Bihar Excise Act.
  • Whether the petitioner’s lack of possession and clean antecedent justify the grant of anticipatory bail.
  • Whether the trial court must verify the petitioner’s criminal antecedent before confirming the provisional bail.

Subjects

  • anticipatory bail
  • Bihar Excise Act
  • liquor seizure
  • clean antecedent
  • Section 30(a)
  • Section 482(2)
  • provisional bail

                   learned A.P.P. for the State.

                             2. The petitioner apprehends his arrest in a case

                   Bihar Excise Act.

                             3. Learned counsel for the petitioner submits that the

petitioner is a person with clean antecedent and allegation is of

recovery of 2203.2 litres of liquor from three different vehicles.

police prior to institution of the instant FIR, which casts an

aspersion on the case of the prosecution and the name of the

local person, who disclosed the name of the petitioner, is not

disclosed in the FIR, when petitioner has not been implicated

based on secret information and is a person with clean

          antecedent.

                   5. Learned A.P.P. for the State opposes the prayer for

          anticipatory bail of the petitioner.

                   6. Considering the submissions made by the learned

event of his arrest or surrender within a period of six weeks
