The Court ordered provisional anticipatory bail with conditions, pending verification of the petitioner’s criminal antecedents.

Summary

The petitioner, Upendra Kumar, sought anticipatory bail fearing arrest under Section 111(2) of the B.N.S. and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 for alleged recovery of 750 litres of liquor from his motorcycle. He argued that he was not arrested on the spot, no liquor was found in his possession, and he was unaware that a third party, Suraj Kumar, misused his vehicle. The State opposed the bail, contending the seriousness of the offences. The Court, after considering the submissions, granted provisional anticipatory bail subject to a Rs.5,000 bond, two sureties, and verification of the petitioner’s criminal antecedents. The order stipulated that if more than one prior case is found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438(2) of the Cr.P.C. and Section 482(2) of the B.N.S.S. despite alleged involvement in liquor seizure.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.
