Patna High Court

Sanjay Kumar Singh @ Sanjay SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the allegations were general and omnibus, and therefore granted anticipatory bail to the petitioners subject to the stipulated conditions.

Summary

The petitioners, four brothers, were named in an FIR for allegedly destroying wheat crops belonging to an informant and issuing threats, under several offences of the Bhartiya Nyay Sanhita, 2023. They contended that the case stemmed from a land dispute and that the allegations were vague and omnibus, noting a prior criminal case against them. The State opposed their application for anticipatory bail. The court examined the nature of the allegations and found them to be general, not specifying concrete acts of firing or assault. Consequently, the court ordered that the petitioners be released on anticipatory bail, subject to a bail bond of Rs 10,000 and two sureties, and to appear before the Judicial Magistrate within four weeks, invoking Section 438(2) of the Cr.P.C. and Section 482(2) of the Bhartiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners given the allegations of crop destruction and threats.
  • Whether the allegations in the FIR are sufficiently specific or are general and omnibus.
  • Whether Section 438 of the Cr.P.C. and Section 482 of the Bhartiya Nagarik Suraksha Sanhita are applicable for granting anticipatory bail.
