Patna High Court

Jagarnath RayversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court held that the petitioner was not in conscious physical possession of the recovered liquor and therefore granted bail subject to conditions.

Summary

Jagarnath Ray was named in an FIR for alleged illegal manufacturing and trading of illicit liquor, with 1013.25 litres of IMFL recovered from an open bamboo grove behind a third party's house. The petitioner argued that the liquor was not in his conscious physical possession, as it was recovered from a public area. The State opposed bail, citing the seriousness of the excise offences and the petitioner's involvement in three other criminal cases. The court examined whether the recovery constituted prima facie possession sufficient to deny bail. Finding that the liquor was not in the petitioner's direct possession, the court directed that he be released on bail upon furnishing a bond of Rs. 10,000 with two sureties, subject to conditions under Section 482(2) of the BNSS.

Issues considered

  • Whether the recovery of illicit liquor from a public area establishes conscious physical possession by the petitioner for bail purposes
  • Whether bail can be granted under Section 482(2) of the BNSS despite the nature of the excise offences
  • Whether the petitioner's involvement in other criminal cases affects the grant of bail
