Patna High Court

AJAY KUMAR JHA @ AJAY JHAversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court ordered the release of the petitioner on bail with a cash bond and two sureties, subject to cancellation if he attempts to delay the trial.

Summary

Ajay Kumar Jha was arrested in connection with offences under Sections 420, 467, 468, 471, 506 and 34 of the Indian Penal Code. He had earlier applied for regular bail, which was withdrawn, and after the charge‑sheet was filed on 14‑Oct‑2025 he renewed his bail prayer. The petitioner had been in custody since 9‑Dec‑2024. The State opposed the bail, arguing the seriousness of the offences. The Patna High Court, after considering the submissions, ordered his release on bail upon furnishing a cash bond of Rs 10,000 and two sureties of the same amount, subject to the trial court’s power to cancel the bail if the petitioner attempts to delay the trial. The order thus grants regular bail with conditions.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the offences under Sections 420, 467, 468, 471, 506 and 34 IPC.
  • Whether the conditions imposed by the trial court are sufficient to ensure the trial is not delayed.

                                3. Learned counsel for the petitioner submits that

petitioner had earlier moved before this Court seeking regular

permitted to be withdrawn by an order dated 22.08.2025 with

liberty to the petitioner to renew his prayer for bail after framing

                   of charge.

                                4. Learned counsel for the petitioner submits that

                                                       2/2

charges against the petitioner stand framed by an order dated

14.10.2025 as would manifest from Annexure-3 to the

anticipatory bail application. It is further submitted that

petitioner is in custody since 09.12.2024.

                                  5. Learned A.P.P. for the State and learned counsel

appearing on behalf of the informant opposed the prayer for

                     regular bail of the petitioner.

                                  6. Considering the submissions aforesaid, the

petitioner, above named, is directed to be released on bail on

furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand)

with two sureties of the like amount each to the satisfaction of

the learned Trial Court where the case is pending in connection

                                  7. However, it is made clear that if the learned Trial

Court comes to a conclusion that the petitioner, after his release

on bail, is trying to delay the trial of the case in any manner, the

learned Trial Court shall be at liberty to cancel the bail bonds of

                     the petitioner.

                                                                         (Satyavrat Verma, J)
