Summary

Namuna Kumar was apprehended for alleged possession of 84 litres of beer in a case registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022. The petitioner claimed innocence, arguing that the recovered beer was found in the open waters of the Ganga River and not in his possession, and highlighted his clean antecedent. The State opposed bail, contending the seriousness of the offence despite the petitioner’s clean record. The Court considered the facts, the statutory provisions on bail, and the petitioner’s antecedents, and ordered that bail be granted if the petitioner surrenders within four weeks, furnishes a bail bond of ₹30,000, and complies with conditions under the Bharatiya Nagrik Suraksha Sanhita, 2023. The order was pronounced by Justice Dr. Anshuman.
