The Court granted bail to the petitioner.

Summary

The petitioner, Santu Kumar, was arrested in connection with a kidnapping case involving a minor, alleged under Sections 137(2) and 96 of the Bharatiya Nyaya Sanhita and Sections 8 and 12 of the POCSO Act. He had been in custody since 28 September 2025 and claimed innocence, asserting that the alleged relationship with the victim was consensual. The victim's statement recorded under Section 180 of the BNSS was produced, indicating a consensual relationship. The Court ordered the petitioner to be released on bail upon furnishing a bond of Rs.10,000 with two sureties, while reserving its right to pass a separate judgment on the merits of the case.
