Holding

The Court granted provisional anticipatory bail to the petitioner subject to conditions and verification of antecedents.

Summary

The petitioner, Sanjit Kumar, sought anticipatory bail fearing arrest in a case under Section 30(a) of the Bihar Excise Act concerning alleged recovery of ten litres of liquor from a public place. He asserted a clean criminal record and argued that the alleged recovery was not from his possession and was reported by a watchman with whom he has an inimical relationship, raising doubts about the prosecution's case. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail conditioned on a bail bond of Rs. 500 with two sureties and directed the trial court to verify the petitioner’s antecedents within six weeks. If any prior case is found, the bail would not be confirmed; if the petitioner is found to have a clean record, the bail would be confirmed forthwith. The order reflects the Court’s discretion under Section 482(2) of the BNSS to prevent undue arrest while ensuring verification of criminal antecedents.

Issues considered

  • What is the appropriateness of granting anticipatory bail to the petitioner under Section 30(a) of the Bihar Excise Act?
  • Whether the petitioner’s alleged clean antecedent and the circumstances of the alleged recovery justify provisional anticipatory bail?

term. It is also submitted that if Chowkidar was aware of the

involvement of the petitioner in the occurrence then why he did

not inform the police prior to institution of the instant FIR
